Terms and Conditions

By accessing and using our website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. Your continued use of our platform constitutes acceptance of these terms, which may be updated from time to time in accordance with applicable Canadian laws.

These Terms and Conditions (“Agreement”) apply to Scholara’s website, tutoring services, and related offerings (collectively, the “Platform,” “Website,” or “Services”). By accessing or using our Platform or receiving tutoring services from Scholara Tutoring Inc. (“Scholara,” “we,” “our”), you agree to be bound by this Agreement. Scholara reserves the right to deny or discontinue access to any user who violates these Terms.

1. Definitions

“Agreement” – This document in its entirety.
“User” – Anyone using or registering for our Services.
“Tutoring Fees” – Fees paid for tutoring services.
“Registration” – The account creation or intake process.
“Service” – All tutoring services delivered online or in-person.
“Tutoring Plan” – Prepaid tutoring hours or recurring packages.
“Third-Party Payment Processor” – Services used for payment processing.
“Platform Contents” – All materials, text, graphics, images, and software on our Website.

2. Eligibility

You must be at least 18 years old to register for or purchase tutoring services. Parents or legal guardians must consent on behalf of minors.
Users accessing the Platform from outside Canada are responsible for compliance with all applicable laws.

 

3. Privacy and Personal Information

Scholara complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) and all relevant provincial privacy laws.
Use of the Services constitutes consent to the collection, use, and disclosure of personal information as outlined in our Privacy Policy.

 

4. Online Conferencing and Recording

Scholara may use digital platforms such as Zoom, Google Meet, or Microsoft Teams to deliver online tutoring.

Recordings may occur only with prior explicit consent from parents/guardians and students.

Recordings may be used for:

  • Quality assurance

  • Tutor training

  • Safety and monitoring

  • Dispute resolution

  • Legal compliance (if required)

Recordings are securely stored and access is strictly limited to authorized Scholara personnel.

 

5. In-Person Tutoring Services

Scholara offers in-person tutoring at the student’s home or approved public locations. The following terms apply:

5.1 Location & Environment

  • A responsible adult (18+) must remain on-site during the session.

  • The learning space must be safe, quiet, and free from hazards.

  • Students must have all materials ready before the session begins.

  • Pets should be secured if they may cause distractions or safety concerns.

5.2 Safety & Professional Standards

  • Tutors may decline or discontinue a session if the environment is unsafe or inappropriate.

  • Tutors may not transport students in personal vehicles.

  • Tutors may not accept gifts or items of value beyond appropriate tokens of appreciation.

  • Disrespectful or unsafe behaviour may result in termination of services.

5.3 Travel Boundaries

Tutors will travel only within approved service areas. Additional travel fees may apply and will be disclosed in advance.

5.4 Illness Policy

  • Students presenting symptoms of illness must reschedule.

  • Tutors who are ill will not conduct in-person sessions.

  • Scholara may convert an in-person session to online for safety reasons.

 

6. Student Expectations

Students are expected to:

  • Arrive prepared with necessary materials and assignments.

  • Participate actively in the learning process.

  • Complete their own homework; tutors do not complete assignments for students.

  • Ensure a stable internet connection for online sessions.

  • Not invite friends or additional participants without approval.

 

7. Tutor Expectations

Tutors are expected to:

  • Arrive prepared and on time.

  • Maintain professionalism at all times.

  • Bring necessary tools, including devices and whiteboard materials.

  • Communicate with families regarding scheduling (including the parent/guardian for minors).

  • Never accept direct payment; all payments must go through Scholara.

 

8. Sharing Information

Families and tutors may exchange contact information for scheduling. For minors, parents/guardians must be included in all communications.

 

9. Payment Terms

All payments must be made in Canadian dollars through our approved third-party payment processors.

Users may select from:

  • Pay-as-You-Go Sessions

  • Recurring Tutoring Plans (Weekly or Semi-Weekly)

Recurring plans renew automatically each month unless cancelled before the next billing cycle.
No refunds are issued for partially used months.

 

10. Refund Policy

  • All tutoring plans must be prepaid.

  • Prepaid hours remain valid for 3 months from the purchase date.

  • Unused hours expire after 3 months and are non-refundable.

  • No refunds are provided for expired or unused tutoring time.

 

11. Cancellation & Rescheduling Policy

This policy applies to both online and in-person sessions.

  • Sessions may be cancelled or rescheduled with no charge if at least 24 hours’ notice is provided.

  • Cancellations made less than 24 hours in advance will be charged the full session fee.

  • Missed sessions (“no-shows”) are charged in full without refund.

  • Same-day rescheduling is not guaranteed and depends on tutor availability.

  • Extenuating circumstances (illness, emergencies) may be considered at Scholara’s discretion.

 

12. Intellectual Property

All content on the Platform is the property of Scholara Tutoring Inc. Users may not reproduce or modify any material without written permission.

 

13. Non-Solicitation Agreement

For 12 months following the use of Scholara’s Services, clients and tutors may not:

  • Work together outside of Scholara

  • Solicit or accept tutoring work outside of Scholara

  • Divert tutors or clients from Scholara

Violations may result in legal action.

 

14. Limitation of Liability

Scholara is not liable for indirect, incidental, or consequential damages arising from use of the Platform or Services.
Your sole remedy for dissatisfaction is to discontinue use of the Services.

 

15. Governing Law

This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada.
All disputes must be brought exclusively in Ontario courts.

 

16. Dispute Resolution

Any disputes arising from this Agreement will be resolved through binding arbitration in Toronto, Ontario, under the Arbitration Act, 1991 (Ontario).

 

17. Force Majeure

Neither party is responsible for delays caused by circumstances beyond their control, including illness, power outages, or natural disasters.

 

18. Miscellaneous

  • If any provision of this Agreement is found invalid, the remaining provisions remain in effect.

  • This Agreement constitutes the entire understanding between the parties.

  • Users may not assign this Agreement without Scholara’s written consent.

  • Scholara may assign this Agreement without notice.
